FR petition filed against Cabraal, dismissed

A fundamental rights petition filed by Ven. Thiniyawala Palitha Thero against former Central Bank Governor - Ajith Nivard Cabraal and others has been dismissed by the Supreme Court (SC) without being taken up for hearing.

A three-judge bench comprising Chief Justice Preethi Padman Surasena, Mahinda Samayawardhena, and Sampath Wijeratne had delivered this verdict.

The petitioner had alleged that USD 6.5 million was paid in 2014 to one Imam Suberi - a Pakistani national residing in the US, without proper approval, to enhance Sri Lanka's image.

Presidential Counsel Farman J. Cassim, appearing for the petitioner, argued that Cabraal's actions were unlawful and violated fundamental human rights.

Attorney Suren Gnanaraaj, representing Cabraal, highlighted that previous cases in two Magistrate's Courts had already established his client's innocence, and a prior revision petition had also been rejected.

After reviewing the submissions from both factions, the three-judge bench concluded that the petition did not present sufficient grounds for a lawsuit and dismissed the case.
