The US Labor Department is clarifying the rules around tip pooling arrangements and wage garnishment in two new opinion letters issued just before President Joe Biden's term is set to end.
Workers who have significant equity in their workplace are considered managers that aren't allowed to participate in tip pooling arrangements under the Fair Labor Standards Act, the DOL's Wage and Hour Division said in one of the guidance letters dated Dec. 18.
